Man i got an aggravated assault by threat case right now I’m a first-time offender. I got threatened first but the victim lied an afterwards wrote a non prosecution form but prosecutor not dissmissing hopefully i can get it dropped to a misdemeanor

I will not accept a plea deal. If the prosecution is not willing to simply reduce the charge to a misdemeanor without a plea, how/when can I get the judge to determine the case is a misdemeanor offense and not a felony? It is considered a wobbler crime.

Listening to this makes me so angry all over again. I new I had a terrible lawyer but he never offered any of these options. I had a solid work history was employed at that time for over 10 years the same place, no priors not even parking tickets, was a mother of 6 with a college degree. I’m just now working on a reduction or expungement so that I can get my clinical license.
